Agreement and Terms of Service:

This agreement outlines the terms and conditions governing your use of the globe-auctions.ca website (“Website” or “Service”) and any related products and services (collectively referred to as “Services”). This Agreement is a legally binding contract between you (“User”, “you”, or “your”) and Globe Auctions (“Globe Auctions”, “we”, “us”, or “our”). By accessing or using the Website and Services, you acknowledge that you have read, understood, and agree to comply with the terms of this Agreement.

If you are entering into this Agreement on behalf of a business or legal entity, you represent and warrant that you have the authority to bind such entity to the terms of this Agreement. In such case, “User”, “you”, or “your” will refer to that entity. If you do not have such authority, or if you do not agree with the terms of this Agreement, you must refrain from accepting this Agreement and you are not authorized to use the Website or Services.

You acknowledge and agree that this Agreement is a legally binding contract between you and Globe Auctions, despite being an electronic agreement that does not require a physical signature, and it governs your use of the Website and Services.

Notice of Terms and Conditions:

1. Bidding

Do not place a bid if you are uncertain about any item, as all items are considered unverified, used, and untested. All items for each auction will be available for viewing and/or inspection on Thursday (prior to the relevant auction). As such, all items are sold “as-is, where-is,” with no returns or exchanges. No guarantees, warranties, returns, or exchanges shall be provided under any circumstances. Accordingly, the buyer assumes full responsibility for the condition and functionality of the items purchased. Globe Auctions (the Auctioneer) expressly disclaims any and all liability arising from or in connection with the condition, safety, fitness for purpose, or functionality of any item sold.

2. Pickup

Items must be picked up within two (2) days after the auction, specifically on Saturday and Monday between 10:00 AM and 4:00 PM. Failure to pick up items within this designated period will result in the items being discarded, and no refunds will be issued, as per the terms agreed upon during registration.

3. Shipping

For shipping inquiries, please contact the UPS representative directly at +1 825 437 2144 or via email at [email protected] after receiving your paid invoice. Ensure you reach out before Monday to allow UPS to collect and process all invoices in time for weekly shipping.

Globe Auctions does not provide shipping, handling, packing, or delivery services for any items sold. By placing a bid, the bidder acknowledges and agrees that: All logistics related to the removal and transportation of purchased items are the sole responsibility of the bidder. Globe Auctions shall not be held liable for any costs, damages, delays, or issues arising from the bidder’s chosen method of shipping or third-party carrier. All duties, taxes, tariffs, customs fees, and any other charges related to the transport or import/export of items are the exclusive responsibility of the bidder. Failure to arrange timely shipping or pickup will not be grounds for cancellation or refund of the purchase. Do not place a bid unless you are fully capable of arranging and covering the cost of shipping independently.

4. Verification/Authorization

  • For payments exceeding $100, Globe Auctions may request personal identification to verify your details on file, including your address and credit card information. In the event of a mismatch, items will be held until verification is completed in due course.
  • If you have authorized a third party to pick up your items, you need to provide both your photo ID and the authorized person’s name and ID. Verification of the authorized person’s ID will be retained for a period sufficient to accommodate any potential chargeback process. Items will not be released to an unauthorized individual or without proper ID.

5. Chargeback Agreement

By mutual agreement, you waive the right to initiate or reclaim any chargeback for the amount paid for the items once the transaction has been completed.

Other Relevant Terms & Notices:

  1. The User agrees to pay all applicable fees and charges associated with their account in accordance with the fee schedule and billing terms in effect at the time such charges become due. Upon the conclusion of an auction, all charges will be automatically billed to the credit card provided during registration.
  2. New online bidder profiles may take up to two business days to be approved. If we, at our sole discretion, determine that a transaction constitutes a high-risk activity, you may be required to provide additional verification, including but not limited to a valid government-issued photo identification and/or a recent bank account statement corresponding to the credit or debit card used.
  3. We reserve the right to modify product offerings, pricing, and related terms at any time without prior notice. We may refuse or cancel any order and, at our discretion, impose quantity limits per individual, household, or order. These limitations may apply to orders associated with the same customer account, payment method, or billing and/or shipping address.
  4. In the event of an order change or cancellation, we will make reasonable efforts to notify you using the contact details provided at the time of order placement. Refunds, if applicable, will be processed accordingly.
  5. The Website and Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, images, pricing, promotions, or availability. We reserve the right to correct such errors or inaccuracies and to amend or cancel orders affected by them, at any time, without prior notice, including after submission.
  6. We are not obligated to update, amend, or clarify information on the Website or Services, including pricing data, except as required by law. The absence of a specified update date shall not be interpreted to imply that all content is current.
  7. If you choose to enable, access, or use third-party services through the Website, you acknowledge that such use is governed solely by the applicable terms and policies of those third-party services. Globe Auctions makes no representations or warranties regarding any third-party services or their practices, including their contents, data or security measures.
  8. The User irrevocably waives any claims against Globe Auctions arising from their use of or interaction with third-party services. Globe Auctions disclaims all liability for any loss or damage, whether actual or alleged, resulting from such interactions.
  9. You may be required to register with or access third-party services directly through their platforms. By doing so, you expressly consent to the disclosure of necessary data to facilitate such integrations.
  10. Certain items in this auction may be subject to a reserve price. Images are for illustrative purposes only and may not accurately represent the actual items. Some images may have been sourced online. We strongly recommend inspecting items in person or reviewing all available photographs prior to bidding. Reserve prices, as set by the consignor, may be confirmed or updated shortly before or during the live auction. These cannot be disclosed in advance and will only be visible once the consignor’s conditions are met.
  11. The name “Globe Auctions” and all related names, logos, and trademarks are the exclusive property of Globe Auctions or its licensors. Unauthorized use is strictly prohibited.
  12. All content on the Website, including text, images, graphics, and software, is protected by intellectual property laws and contractual rights. No part of the Website may be copied, reproduced, or used without prior written consent, except where expressly permitted.
  13. Any unauthorized use or modification of content from the Website may constitute an infringement of our intellectual property rights and is strictly prohibited.
  14. The User may encounter advertisements or promotional content from third parties while using the Website. Any interaction, including transactions, is solely between the User and the respective third party. Globe Auctions disclaims any liability arising from such engagements.
  15. The Website and Services may contain links to third-party websites, applications, or resources. Unless expressly stated, such links do not imply endorsement or affiliation. We do not assume any responsibility for the practices or content of such third parties.
  16. Access to third-party resources or external websites is at the User’s sole risk. It is the User’s responsibility to review and understand the applicable legal terms, conditions, and privacy policies of such third-party platforms prior to use.
  17. The Website and Services are provided on an “as is” and “as available” basis. All warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement, are disclaimed.
  18. All auction items are sold “as-is,” untested, and without any warranty as to condition or function. All sales are final, with no returns or exchanges. By bidding, you assume full responsibility for the purchased items, and release Globe Auctions from any liability regarding its condition or usability.
  19. We do not warrant that the Services will operate without interruption, be error-free, secure, accurate, reliable or meet the User’s specific requirements. Any material downloaded is at the User’s own risk.
  20. No information, whether oral or written, obtained through the Website shall create any warranty not expressly stated herein. Globe Auctions does not confirm or extend any manufacturer’s warranties.
  21. Certain items made available at auction may be damaged, recalled, counterfeit, or otherwise deemed unsafe. Such items may be suitable only for parts or for non-consumer use. By placing a bid, the bidder acknowledges and accepts all associated risks and confirms that they have relied solely on their own inspection and conclusion.
  22. The Listing Catalogue is provided solely as a guide, based on information obtained from sources deemed reliable, including the Consignor. However, no representations or warranties are made regarding its accuracy or completeness. The Auctioneer shall not be held liable for any errors, omissions, or inaccuracies in the Catalogue, and no sale shall be invalidated on such grounds.
  23. All items depicted, described, or referenced in any medium are presented solely for illustrative purposes. The actual items made available for auction may vary in appearance, specifications, or condition from such representations. Any prices shown, including historical Maximum Sale Prices (MSP), reflect past valuations and do not represent current market value. Accordingly, no warranty, assurance, or representation is made regarding the accuracy, currency, or applicability of any such pricing information.

These Terms constitute the entire agreement between the Auctioneers and the Purchaser.

  1. All successful bidders shall be liable to pay a Buyer’s Premium, namely: 15% of the final bid amount for regular auctions, in addition to a handling fee of $1.00 per item.
  2. By accepting these Terms and Conditions, you expressly consent to Globe Auctions and its affiliated marketing partners collecting and using your contact information, including your email address and telephone number, for the purpose of sending promotional and marketing communications relating to Globe Auctions and its services. You may receive emails or other communications containing updates, promotional offers, and auction-related information. You may withdraw your consent and unsubscribe from such communications at any time by notifying us via email using the unsubscribe instructions provided in the communication or by contacting us directly.
  3. To the fullest extent permitted by applicable law, Globe Auctions, including its affiliates, officers, directors, employees, agents, suppliers, and licensors, shall not be liable for any indirect, incidental, special, punitive, or consequential damages. This includes, without limitation, damages for loss of profits, data, anticipated savings, business interruption, reputational harm, or any other economic or commercial loss, arising under any theory of liability, whether in contract, tort, negligence, or otherwise—even where such damages were foreseeable or Globe Auctions was advised of the possibility thereof.
  4. Any dispute, claim, or legal proceeding arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of the Province of Alberta, with venue exclusively in the judicial region of Calgary. The User irrevocably attorns to the personal jurisdiction of such courts and waives any right to object to the venue or to claim that the forum is inconvenient. For greater certainty, the United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.
  5. Globe Auctions reserves the right to modify this Agreement at any time. Any such modifications shall take effect upon posting the revised version to the Website. Your continued use of the Website or Services constitutes your acceptance of the revised terms.
  6. By accessing or using the Website and Services, the User confirms they have read, understood, and agreed to be bound by the terms and conditions of this Agreement. If the User does not agree to these terms, they are not authorized to use the Website or Services.
